Transcript of the Will of Thomas Daniel of Dean Row

In the Name of God Amen I Thomas Daniel of Dean Row in the Parish of Wilmslow and County of Chester, Yeoman, being not well in Bodily Health, but of perfect Mind and of sound Understanding and Memory, Blessed be Almighty God for his Mercies but considering the uncertain Continuity of My Life, and the many Hazards and Dangers that it is Obnoxious to, and being desirous to leave that Small Estate and Fortune which God Almighty has been pleased to Bless me with, in my Family, with as much Peace and Union as may be, and that I may have nothing of this Transitory World or the Entanglements thereof to encumber my Thought and Contemplation with, at my going out of it, but to think and meditate of the next World, and the inestimable Blessings and Comforts that are there to be enjoyed, I do make and order this my last Will and Testament in Manner following, that is to say, first I resign my Soul into the hands of the great and most merciful God that made it, in hoping through the ??? Merits of my Blessed Lord and Saviour Jesus Christ to having a Joyful Resurrection to Life Eternal in Heaven, and my body I recommend to the Earth to be buried in decent Christian burial at the discretion of my Executors hereinafter named. And as for my temporal estate and goods I give and dispose of the same as followeth, first I order and appoint my just Debts, Funeral Expenses and Probate of this my last Will and Testament to be fully paid and discharged. And as for and touching the Remainder of my Estate and Effects, I give and bequeath, and dispose thereof in the following manner and form.

Item, I give and bequeath unto Martha my Dearly Beloved Wife all and every part of my Messuage and Tenement situate in Dean Row aforesaid which I hold by lease under the Countess Dowager of Stamford to be by her freely enjoyed for and during the Term and Time of her Natural Life together with all my Personal Estate of what nature or kind occurs during her Natural Life.

Item, I give and bequeath unto my daughter Ann Rodes the sum of five pounds Sterling.

Item, I give and bequeath unto my daughter Martha Royle the sum of five pounds Sterling.

Item, I give and bequeath unto my daughter Esther Royle the sum of six pounds Sterling. Also I give to my daughter Esther Royle my Bed warming pan.

And my Will and meaning is that all the aforesaid Sums of Money be raised and paid out of my Real Estate by my Executors hereinafter named, and also it is my Will that each of the aforesaid Legacies be duly paid and discharged within Twelve Months after my Wifes decease.

And if it so happens that any of Daughters Die before the Legacies become due and payable, then and in such case it is my Will that such Legacy or Legacies be equally divided amongst her children Share and Share alike.

Item, I give and bequeath unto my son Thomas Daniel one Bed which stands in the Chamber over the House, and also one Brass Furnace Pan, and one Fire Grate and ??? Grate. Also I give unto my son Thomas all my clothing and Wearing Apparel together with all my Working Tools and Husbandry Utensils. Further I order and appoint my son Thomas Daniel to bear and pay Forty Shillings towards my Funeral Expenses and to be raised out of my Real Estate. It is also further my Will that a Life be put into my Lease of Estate in the Twelve Months after my Death, and the charges of the said Life to be paid out of my Personal Estate. And all the rest residue and remainder of my Personal Estate I give to my aforesaid three Daughters to be equally divided amongst them Share and Share alike. And it is further my Will that if any of my aforesaid Legatees raise any disturbance or be any ways dissatisfied with what I have bequeathed unto them, then and in such case her or they shall be utterly debarred from the Legacy hereby left them and in lieu of which shall only have the sum of one shilling.

Item, I give and bequeath unto my son Thomas Daniel, his Heirs and assignees for ever at the time of my Wifes decease all and every part of my Real Estate situate in Dean Row in the Parish of Wilmslow and County of aforesaid with all its Rights, Encumbrances, and Appertanancies to the same belonging, provided he my said Son Thomas Daniel pay all the aforesaid Legacies and Bequests according to this my last Will and Testament.

Lastly, I Nominate and Constitute and Appoint Martha my Dearly Beloved Wife and Thomas Daniel my Son Executors of this my last Will and Testament hereby revoking all former Will and Wills and Executors by me heretofore made, and Ratifying and Confirming this and no other to be my last Will and Testament.

In witness whereof I the said Thomas Daniel the Testator have hereunto set my Hand and Seal this 12th Day of August in the year of our Lord One Thousand Seven Hundred and Seventy One.
